Welcome to MobiRide Eswatini
These Terms of Service ("Terms") constitute a legally binding agreement between you and MobiRide Eswatini ("MobiRide," "we," "us," or "our") governing your use of our ride-hailing and delivery services, mobile applications, and website (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. We encourage you to read these Terms carefully before using our Services.
Account Registration
To use our Services, you must create an account. You must be at least 18 years old to register for an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
- Accuracy:You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
- Security:You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You are responsible for all activities that occur under your account.
- One Account:You may only maintain one active account with MobiRide. Creating multiple accounts may result in suspension or termination of all accounts.
User Responsibilities
You agree to use our Services in compliance with all applicable laws, regulations, and these Terms. You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, or impair the Services.
Prohibited Activities
The following activities are strictly prohibited and will result in immediate account suspension and reporting to law enforcement:
- Transporting illegal goods or substances
- Using the Services to commit any criminal activity
- Harassing, threatening, or abusing drivers or other users
- Any activity that violates Eswatini law or regulations
Payments & Pricing
3.1 Fare Calculation
Charges for services or goods from Third-Party Providers are inclusive of applicable taxes where required by law. All charges are final and non-refundable, except as otherwise required by law or as determined by MobiRide in its sole discretion.
3.2 Currency
Payments will be facilitated through the payment method designated in your account. All charges will be made in Eswatini Lilangeni (SZL) or South African Rand (ZAR) at 1:1 parity, as applicable.
3.3 Cancellation Fees
You may be charged a cancellation fee if you cancel a service request after a Third-Party Provider has been assigned or has arrived at your location. The cancellation fee will be communicated to you before you confirm the cancellation.
Liability & Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MOBIRIDE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the fullest extent permitted by law, MobiRide shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Services.
Termination
MobiRide may terminate these Terms or your access to the Services at any time, with or without cause, with or without notice, effective immediately. MobiRide may also terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You may terminate this agreement at any time by closing your account and discontinuing use of the Services. Upon termination, your right to use the Services will immediately cease.
